fa تحلیل و آسیب شناسی پارک‌های معاصر از منظر فقهی و اخلاقی (مورد پژوهی: پارک‌های معاصر تبریز) مطالعات تطبیقی معماری و شهرسازی در حوزه فرهنگی ایران the comparative studies of Architecture and Urbanism in the realm of Cultural Iran پژوهشي Original Article <div style="text-align: justify;">امروزه جهان با مشکلات زیست محیطی و کمبود فضای سبز مواجه می‌باشد. در ایران نیز فضاهای سبز و پارک‌های ساخته شده با فرهنگ و اقلیم این سرزمین متناسب نمی‌باشد و از اصول اولیه باغ سازی فاصله گرفته است. امروزه در تمامی مقیاس‌ها با کمبود فضای سبز و طراحی و ساخت غیر اصولی، نا هماهنگ با اقلیم و فرهنگ جامعه مواجه می‌باشیم به این جهت لازم می‌باشد با بررسی اصول فقهی و اخلاقی مرتبط با موضوع تحقیق به بررسی و شناسایی آسیب‌های موجود پرداخته شود. هدف پژوهش تبیین و آسیب شناسی جایگاه طبیعت در معماری پارک‌های معاصر می‌باشد و به سوال‌های معیارهای موثر از منظر فقه در طراحی پارک‌های معاصر چیست؟ و اصول اخلاقی تاثیر گذار در طراحی فضاهای سبز کدام‌اند؟ به روش توصیفی تحلیلی پاسخ داده خواهد شد. شیوه جمع آوری اطلاعات کتابخانه‌ای و پیمایشی می‌باشد. در راستای پاسخ به سوال پژوهش اصول فقهی که بررسی شده‌اند قاعده نفی سبیل، حلال و حرام، لاضرر، اتلاف و اهم و مهم و اصول اخلاقی خدا محوری، معنویت، عدالت، کرامت انسانی، قناعت و ساده زیستی، احترام به طبیعت، خانواده محوری و نشاط و شادی حقیقی می‌باشند. با توجه به پارک‌های معاصر در شهر تبریز می‌توان اذعان داشت که هیچ کدام از پارک‌های معاصر در انطباق با قواعد فقهی و اصول اخلاقی مطرح شده نیستند. با توجه به اینکه فضاهای مسکونی معاصر مانند خانه‌های سنتی با فضای سبز ارتباط ندارد دسترسی واحدهای آپارتمانی به پارک‌ها و بوستان‌ها اهمیت زیادی پیدا می‌کند. که می‌توان طراحی و ساخت فضاهای سبز را با توجه به احکام اسلامی انجام داد. به عبارت دیگر کاربری فضای سبز می‌تواند تحت تاثیر قواعد فقهی و اخلاقی شکل گیرد، توجه به اصول باغسازی ایران، استفاده از طبیعت بکر و افزایش عملکرد و... مواردی هستند که می‌توانند در ارتقای بهبود فضاهای سبز نقش موثری داشته باشند.</div> <span style="font-size:11pt"><span style="line-height:normal"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:Calibri,sans-serif"><span lang="AR-SA" style="font-size:13.0pt"><span b="" mitra="" style="font-family:"><span style="color:red"></span></span></span></span></span></span></span></span> <div style="text-align: justify;">Today, the world is confronted with serious environmental challenges and a shortage of green spaces. In Iran, many urban green spaces and parks have been designed and constructed without proper consideration of the local culture and climate, deviating significantly from the fundamental principles of traditional Persian garden design. At almost every scale, there is both a lack of green space and widespread unprincipled planning and construction, often incompatible with the climatic and cultural characteristics of society. This highlights the need to examine relevant jurisprudential and ethical principles in order to identify existing deficiencies and offer solutions. A review of contemporary parks in Tabriz reveals that none of them fully comply with the jurisprudential rules and ethical principles considered in this study. Since modern residential complexes&mdash;unlike traditional houses&mdash;are generally disconnected from natural green areas, access to public parks and gardens has gained critical importance. Designing and developing green spaces in accordance with Islamic regulations and ethical considerations offers significant potential. In other words, the functional use of green space can and should be guided by jurisprudential and moral principles.
